社會(huì)保障廳工作制度

(一)根據(jù)國家有關(guān)勞動(dòng)和社會(huì)保險(xiǎn)工作的方針政策,制定相應(yīng)政策和實(shí)施辦法;研究制訂勞動(dòng)和社會(huì)保險(xiǎn)制度改革方案;編制全省勞動(dòng)和社會(huì)保險(xiǎn)事業(yè)發(fā)展規(guī)劃和年度工作計(jì)劃并組織實(shí)施。

(二)受委托研究起草有關(guān)勞動(dòng)和社會(huì)保險(xiǎn)行政管理的地方性法規(guī)、規(guī)章草案,經(jīng)審議通過后組織實(shí)施;依法行使國家勞動(dòng)和社會(huì)保險(xiǎn)的監(jiān)督檢查職權(quán),指導(dǎo)監(jiān)督全省勞動(dòng)和社會(huì)保險(xiǎn)監(jiān)督檢查機(jī)構(gòu)的工作。

(三)統(tǒng)籌管理全省勞動(dòng)力資源開發(fā)利用和就業(yè)工作;指導(dǎo)全省就業(yè)服務(wù)機(jī)構(gòu)工作;制定職業(yè)介紹機(jī)構(gòu)管理規(guī)則并實(shí)施監(jiān)督;組織實(shí)施農(nóng)村勞動(dòng)力跨地區(qū)有序流動(dòng)的政策和措施;按分工管理公民出境就業(yè)和境外人員入境就業(yè)工作;負(fù)責(zé)外國在浙從事勞動(dòng)力招聘中介、咨詢和培訓(xùn)業(yè)務(wù)機(jī)構(gòu)的資格管理。

(四)根據(jù)國家頒布的職業(yè)分類、職業(yè)技能標(biāo)準(zhǔn)和行業(yè)標(biāo)準(zhǔn),組織制定具體實(shí)施辦法;綜合管理全省技工學(xué)校、就業(yè)訓(xùn)練中心和社會(huì)力量舉辦的職業(yè)培訓(xùn)機(jī)構(gòu);負(fù)責(zé)管理在職職工技能培訓(xùn)和失業(yè)人員、企業(yè)下崗職工再就業(yè)培訓(xùn)工作;組織實(shí)施勞動(dòng)預(yù)備制度。

(五)制定勞動(dòng)關(guān)系調(diào)整的基本規(guī)則;制定和實(shí)施勞動(dòng)合同、集體合同、勞動(dòng)爭議仲裁的規(guī)則;組織實(shí)施企業(yè)職工工作時(shí)間、休息休假、職工福利制度和女工、未成年工特殊勞動(dòng)保護(hù)政策;負(fù)責(zé)有關(guān)政策性安置和調(diào)配工作;參與評(píng)定國家和省級(jí)企業(yè)勞動(dòng)模范。

(六)負(fù)責(zé)企業(yè)職工工資的宏觀調(diào)控工作;研究制訂并組織實(shí)施企業(yè)工資指導(dǎo)線、工效掛鉤、最低工資標(biāo)準(zhǔn)、行業(yè)工資收入調(diào)節(jié)政策和國有企業(yè)經(jīng)營者收入分配政策;負(fù)責(zé)審核省、部屬企業(yè)的工資總額;負(fù)責(zé)省屬國有企業(yè)主要負(fù)責(zé)人年薪制的實(shí)施工作。

(七)制訂企業(yè)養(yǎng)老、失業(yè)醫(yī)療、工傷、生育等社會(huì)保險(xiǎn)的基本政策和基本標(biāo)準(zhǔn)并組織實(shí)施和監(jiān)督檢查。

(八)制訂全省社會(huì)保險(xiǎn)基金收繳、支付、管理、運(yùn)營的政策并組織實(shí)施;對(duì)社會(huì)保險(xiǎn)基金管理實(shí)施行政監(jiān)督;制定社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)的管理規(guī)則;會(huì)同有關(guān)部門制定實(shí)施社會(huì)保險(xiǎn)省級(jí)調(diào)劑金的管理辦法;組織實(shí)施社會(huì)保險(xiǎn)服務(wù)體系建設(shè)規(guī)劃。

(九)制訂機(jī)關(guān)、事業(yè)、企業(yè)單位補(bǔ)充養(yǎng)老保險(xiǎn)、補(bǔ)充醫(yī)療保險(xiǎn)的政策和補(bǔ)充保險(xiǎn)承辦機(jī)構(gòu)資格認(rèn)定標(biāo)準(zhǔn);審查認(rèn)定有關(guān)機(jī)構(gòu)承辦補(bǔ)充保險(xiǎn)業(yè)務(wù)的資格。

(十)承擔(dān)全省勞動(dòng)和社會(huì)保險(xiǎn)的統(tǒng)計(jì)和信息工作,組織建設(shè)全省勞動(dòng)和社會(huì)保險(xiǎn)信息網(wǎng)絡(luò),定期勞動(dòng)和社會(huì)保險(xiǎn)事業(yè)統(tǒng)計(jì)、信息資料發(fā)展預(yù)測報(bào)告。

(十一)組織全省勞動(dòng)和社會(huì)保險(xiǎn)領(lǐng)域科學(xué)技術(shù)研究及成果推廣應(yīng)用、產(chǎn)業(yè)發(fā)展工作;負(fù)責(zé)全省勞動(dòng)和社會(huì)保障領(lǐng)域標(biāo)準(zhǔn)化工作。

(十二)管理勞動(dòng)和社會(huì)保險(xiǎn)領(lǐng)域業(yè)務(wù)技術(shù)合作。

(十三)承辦省政府交辦的其他事項(xiàng)。

(1)Accordingtorelevantnationallabourandsocialsecuritypolicy,definelocalpolicyandimplementationmethods;investigateanddefinelabourandsocialsecuritysystemreformplans;issueprovinciallabourandsocialsecurityreportonplanningandimplementationofannualwork.

(2)Researchintoanddraftbyentrustmentrelevantlabourandsocialsecurityadministrationandlocalregulations,policiesandorganizeimplementationafterapproval;executenationallabourandsocialsecuritysupervisionrightsandguideandmonitoroverallprovince’slabourandsocialsecurityinstitutions’work.

(3)Unifyandmanageoverallprovincelabourresourcesdevelopmentandemploymentwork;giveguidancetoprovince’semploymentserviceinstitutions;defineemploymentconsultantinstitutionsmanagementregulationsandexecutemonitoring;manageimplementationpolicyandpracticeofrurallabourmigrationacrossregions;manageoverseaemploymentandforeigners’employmentissues;beresponsibleforqualificationmanagementofforeignhumanresourcescompaniesinZhejiangwhichinvolveinconsulting,agenciesandtrainingbusiness.

(4)Accordingtonationalindustrystandardofjobclassificationandprofessionstandards,organizetodesigndetailedimplementationmethods,manageprovince’sskillcollege,employmenttrainingcentersandjobtraininginstitutionssetupbysocialmembers;beresponsibleforskilltrainingofcurrentemployeesandre-employmenttrainingworkforlay-offandunemployedworkers;organizeandimplementlabourcandidatesystem.

(5)Definebasicrulesforlabourrelationshipadjustment;defineandexecutelabourcontract,communitycontract,labourdisputearbitrationregulations;regulateenterpriseworkers’workingtime,holidays,welfaresystemandwomen/youngworkers’speciallabourprotectionpolicy;beresponsibleforarrangementandtransferenceaccordingtovariouspolicies;involveinselectionofnationalandprovincialmodelworkers.

(6)Beresponsibleforenterpriseworkers’wagemacroadjustment;researchonanddefineenterpriseworkers’wageguidelines,indextoprofit,minimumwagestandard,industrywageadjustmentpolicyandincomepolicyofStateOwnedEnterprises;beresponsibleforcheckingprovincialandministryenterprises’totalwage;beresponsibleforprovincialStateOwnedEnterprises’executivemajoymanagementannualincomepolicy.

(7)Definebasicsocialsecuritypolicyintermsofenterprisepension,unemployment,medicalinsurance,disabilityandmaternity,etc.andexecuteimplementationandsupervision.

(8)Definepolicyforprovince’ssocialsecurityfundcontribution,payment,managementandoperationandorganizeimplementation;supervisesocialsecurityfundmanagement;definemanagementrulesforsocialsecurityinstitutions;togetherwithotherrelevantdepartment,defineandimplementmanagementregulationsofsocialsecurityprovincialadjustmentfund;organizetoimplementconstructionplansforsocialsecurityservicesystem.

(9)Definepolicyforcomplementarypension,complementarymedicalinsuranceofgovernmentinstitutions,agenciesandenterprises,definequalificationcriteriastandardforcomplementaryinsuranceinstitutions;checktoprovequalificationforrelevantinstitutionstoconductinsurancebusiness.

(10)Beresponsibleforprovinciallabourandsocialsecuritystatisticsandinformationnetwork,issueregularlylabourandsocialsecuritystatistics,informationdevelopmentprojectionreport.

(11)Organizeprovincelabourandsocialsecurityscientificresearchanditsapplication,promoteindustrydevelopment;beresponsibleforstandardizationofprovince’slabourandsocialsecurityissues.

(12)Managetechnicalco-operationoflabourandsocialsecuritywork.

(13)Executeissuesentrustedbyprovincialgovernment.
